A Brief Overview of the Hong Kong International Arbitration Centre


 

The Hong Kong International Arbitration Centre (HKIAC) was established in 1985 by a group of professionals in an effort to meet the growing need for arbitral services in Asia.

HKIAC Statistics

HKIAC handled 624 cases in 2010. These include 291 arbitrations (of which 175 were international ones), 107 domain name disputes, and 226 mediation cases.

Of the total, 28% involved construction disputes, 55% - commercial ones and 17% - maritime ones.

Attitude of State Courts

According to the information presented on the HKIAC official website Hong Kong's courts are considered pro-arbitration and take a "hands off" approach with respect to arbitration. The new Hong Kong Arbitration Ordinance, effective since 1 June 2011, further strengthens Hong Kong as a user-friendly UNCITRAL Model Law jurisdiction.

Disputes in the Field of IP and Information Technology

HKIAC places significant emphasis on providing online dispute resolution services in a wide variety of areas, including intellectual property and information technology. HKIAC’s goal is to become a leading online dispute resolution centre regarding domain names and E-Commerce.

HKIAC is a partner and manager of the Hong Kong Office of the Asian Domain Name Dispute Resolution Centre, one of four domain name dispute resolution providers approved by the Internet Corporation for Assigned Names and Numbers (ICANN). With this position, HKIAC provides domain name dispute resolution services regarding generic top level domain names (gTLDs) such as .com, .net and .org and Country Code Top Level Domains such as .hk , .cn , .pw , and .ph.

Procedural Rules

HKIAC has adopted Administered Arbitration Rules, Electronic Transaction Arbitration Rules, Securities Arbitration Rules, and Small Claims and Documents Only Procedures.
